Terms of Service

1. Service Description

MakeFig ("the Service") provides AI-powered 3D figurine generation from photographs, including image stylization, 3D model generation, 3MF export, colorization, and smart part splitting for 3D printing. The Service is operated by MakeFig ("we", "us", "our").

2. Accounts

• You must be at least 13 years of age to use the Service.
• One account per person. Multiple accounts are not permitted.
• You are responsible for maintaining the security of your account credentials.
• We may suspend or terminate accounts that engage in abusive behavior, including but not limited to: creating fake accounts, exploiting referral systems, circumventing rate limits, or using disposable email addresses.

3. Credits & Billing

• Credits are a virtual currency used within the Service and hold no cash value.
• Credits expire upon account deletion.
• Subscription credits do not roll over from month to month.
• Free credits, referral bonuses, and promotional credits are non-refundable and hold no cash value.
• Prices may change with 30 days' prior notice.
• Billing descriptor: MakeFig — 3D Figure App.

4. Content Ownership & Licensing

You retain full ownership of photographs and other content you upload to the Service.

4.1 Free Users

• AI-generated content (stylized images, 3D models) is licensed to you for personal, non-commercial use only.
• You may not sell, sublicense, or commercially distribute models generated on a free account.
• Attribution to MakeFig is required when sharing generated content publicly (e.g., "Made with MakeFig").

4.2 Paid Users (Maker / Studio / Business)

• You receive a perpetual, worldwide, royalty-free commercial license to use, modify, 3D print, and sell the generated models.
• No attribution required.
• This license applies to all models in your account, including those generated before upgrading.

4.3 Downgrade / Cancellation

• Models generated during an active paid subscription retain their commercial license permanently.
• New models generated after downgrading to a free account are subject to the free-tier license (personal use only).

4.4 Platform License

• By using the Service, you grant MakeFig a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your generated content for promotional purposes, including but not limited to: website galleries, social media, and marketing materials.
• You may opt out of promotional use by contacting support@makefig.com.
• You may not use generated models to train other AI or machine-learning models without our prior written consent.
• We may use anonymized, aggregated usage data to improve the Service.

5. Acceptable Use

• You must not upload content that is illegal, NSFW, or infringes on third-party rights.
• You must not use the Service to generate content depicting real persons without their consent.
• You must not attempt to reverse-engineer, decompile, or extract the underlying AI models.
• You must not use automated tools to scrape, crawl, or bulk-generate content beyond normal usage patterns.

6. Referral Program

• Referral rewards are subject to change at our discretion.
• Abuse of the referral system — including fake accounts and self-referral — will result in account suspension and forfeiture of all rewards.
• Tier upgrades are based on active subscriber count. If the count drops below the threshold, a downgrade may apply.
• Each tier reward can only be claimed once per lifetime.

7. Refunds

7.1 Credit Packs (One-time Purchase)

• You may request a full refund within 7 days of purchase, provided no credits have been consumed.
• Partially or fully used credits are non-refundable. Digital goods are considered consumed upon use.
• A maximum of 2 refund requests per account lifetime is permitted.

7.2 Subscriptions

• No refunds are issued for subscription payments.
• You may cancel at any time; your subscription remains active until the end of the current billing period.
• Annual subscriptions: no refunds. Cancellation takes effect at the end of the current annual term.

7.3 Failed Generations

• If a generation fails due to a system error on our end, credits are automatically refunded to your account.
• No refund is provided for results you are unsatisfied with, as third-party API costs are incurred upon processing.

7.4 General

• All refunds are processed via Stripe and may take 7–14 business days to appear on your statement.
• We reserve the right to deny refund requests that appear fraudulent or abusive.

8. Third-Party Services

The Service integrates with third-party AI providers for content generation. These providers do not claim ownership of generated outputs. However, we make no guarantees regarding the originality or non-infringement of AI-generated content. You are solely responsible for ensuring your use of generated content complies with applicable laws.

9. Affiliate Links & Recommendations

The Service may display product recommendations with affiliate links. We earn commissions from qualifying purchases. Affiliate relationships do not influence AI generation results. Product availability and pricing are determined by third-party retailers and may change without notice.

10. Limitation of Liability

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for AI generation quality, 3D print failures, or outages caused by third-party services.
• Our maximum aggregate liability is limited to the total amount you have paid to us in the 12 months preceding the claim.

11. Termination

• We may terminate or suspend accounts that violate these Terms.
• You may delete your account at any time from your account settings.
• Upon termination, all unused credits are forfeited.
• Commercial licenses granted during an active paid subscription survive termination.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
